Space Reservation Contract
Contract Terms & Condition
1.
Definitions:
For
the purposes of this contract, the term “exhibitor” shall mean all
employees, contractors, agents or representatives of the company,
partnership, firm or individual to whom space has been allocated for
this exhibition. The term “exhibition” shall mean the exhibition
referred to on the space reservation contract. The term “organizers”
shall mean RadTech China and China International Conference Center for
Science & Technology (CICCST). Term “contract” shall mean the
contract for exhibition space at the Exhibition entered into between the
Organizers and the Exhibitor which incorporates the rules and
regulations.
2.
Application to Participate:
All
applications to participate in the exhibition shall be made on this
application form. Completion of this form shall be deemed to be
confirmation of participation and acceptance by the terms and conditions
of participation. The organizers reserve the right to refuse any
application.
3.
Space Allocation
The
organizers shall allocate exhibition space at their discretion and
reserve the right to change allocations prior to erection of booths, if
special circumstances make such changes necessary.
4.
Use of Exhibition Space
Exhibitors
shall use the allocated space only to display and/or sell items of which
they manufacture, distribute or have a legal right to sell. Sharing or
sub-leasing of booth space is prohibited except with the express
permission of the organizers. Exhibitors shall be liable for damage to
the exhibition hall, stands or furnishings provided by the organizer and
shall make no permanent alterations to stands, pillars, columns, floor
or ceiling within or adjacent to their allocated space.
5.
Payment Terms:
30%
of the charges payable by the Exhibitor under the Contract Form (Unit
Costs) to be paid when submit of the contract form. The balance shall be
paid no later than April 20th, 2005, or will be considered as
cancellation of participation and a 50% payment will be refunded (less a
cancellation fee of 50% payment).
6.
Cancellation:
Upon
withdrawal by exhibitor, payment will be refunded (less a US$ 100
handling fee) if requested in writing and received by the organizers 60
days before the opening date of the exhibition. 50% of payments will be
refunded if requested in writing 30-60 days before the opening date of
the exhibition. No refund will be made if requested within 30 days
before the opening of the exhibition. A full refund of deposit/payment
will be made at the discretion of organizers if the exhibition is
cancelled for any reason, including acts of God, war, political unrest
or other unforeseen circumstances.
7.
Changes
The
organizers reserve the right to change the venue and duration of the
exhibition in the event circumstances require such changes, provided
notice is provided to exhibitors at least 60 days in advance of the
exhibition. Such change shall not affect this contract or the
obligations of the organizers shall not be held liable for compensation
in the event of changes in venue or duration of the exhibit. The
organizers shall not be held liable for any changes in the exhibition
that must be made as a result of force majeure, acts of God, strikes or
lockouts by workmen, or other circumstances beyond the control of the
organizers.
8.
Construction / Decoration of Booths
Standard
booths shall include space, a prefabricated stand with three walls
standfitting, a 220/5A socket, an information counter and two folding
chairs, fascia board with company name in both Chinese and English, 2
spotlights, carpeting, security, daily cleaning and one listing in the
exhibition directory. Exhibitors may decorate stands as needed, subject
to the rules and regulations in the official exhibitors/ manual.
Exhibitor shall be liable for any and all damages resulting from booth
decoration and construction. All exhibits must be constructed and
decorated by 5 p.m on the day prior to exhibit opening and must remain
in place and be staffed throughout the duration of the exhibition.

9.
Movement of Exhibits:
Exhibitors
shall be responsible for transportation of their exhibits and materials
to the exhibition hall and shall bear the cost of such transportation as
well as the cost of and arrangements for storage of exhibits and/or
materials. Exhibits shall be removed from the exhibition hall by 5 p.m
on the last day of move-out and exhibitors shall be responsible for any
cost incurred by the organizers as a result of a delay in removing
exhibits.
10.
Security
The
organizers shall make adequate arrangements to protect exhibitors and
their property during the exhibition, but shall not be liable for lost,
theft or damage to exhibits or the personal property of exhibitors
before, during or after the exhibition.
11.
Hazardous Materials:
Exhibitors
shall not bring any hazardous materials into the exhibition hall and
shall not use or display any devices within the exhibition hall that may
cause serious damage or personal injury. The organizers and local fire
marshal shall have the sole right to determine if an exhibit poses a
danger to life or property and may remove any offending devices or
materials at any time during the exhibition.
12.
Insurance, Liability & Risk
Exhibitors
shall insure, indemnify and hold the organizers and venue owners
harmless with respect to any and all costs, claims, demands or expenses
to which they may be subject as a result of loss or injury to any person
caused by the exhibitor and/or equipment or products brought into the
exhibition hall by the exhibitor.
13.
Supplementary Rules & Regulations:
The
organizers shall have the right to issue supplementary rules and
regulations governing the exhibition and any such regulations shall form
a part of this agreement and shall be binding on exhibitor.
